These are the Terms and Conditions for the services. If you accept a quote or estimate that I supply, in particular, the terms will apply when making orders to Wintadreama Design regardless of the medium used to place the order, be it made through telephone, internet, and verbal communication, the client will be liable for all costs of the order placed.

You acknowledge that you have read, understood and accepted the most current Terms and Conditions as they shall be prescribed by Wintadreama Design.

Please read these Terms and Conditions before ordering any products.

This page explains the Terms and Conditions on which Wintadreama Design Websites, supply the services (“Services”) described on this website www.wintadreamadesign.com to you.

The services include but are not limited to:
Website creation, Website hosting management, Website Domain management,  WordPress Website Service and Graphic design

General Terms
Wintadreama Design expects all customers to keep in contact with me during any on-going project.

The customer agrees to provide any needed information and content required by me in good time to enable me to complete a design or website work as part of an agreed project.

Turnaround times
Turnaround times are normal target times only and Wintadreama Design accepts no liability for failure to meet these times but will use its best endeavors to do so.

Content for any project
You guarantee that all elements of text, graphics, photos, designs, trademarks, or other artwork you provide are either owned by your good selves or that you’ve permission to use them.

You will be solely responsible for the content you provide to me. Wintadreama design is not responsible for proofreading any content.

Wintadreama Design makes no representations to you concerning the content or functionality of your website beyond that in the design agreement.
It is your responsibility to ensure that it meets your requirements.

If you provide Wintadreama Design with goods, material, photographs, film, data or information to be used in any form, you hereby warrant that these do not infringe the rights of third parties and indemnify Wintadreama Design against any action taken against Wintadreama Design by any such third party.

Image quality
Wintadreama Design will inform the customer if images supplied are – in my opinion – not of suitable quality for print. However, if the customer once apprised of this, chooses to retain the use of the image in question, Wintadreama Design will not be held responsible for the quality of reproduction.

Alterations
The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.

The customer also agrees that Wintadreama Design holds no responsibility for any amendments made by any third party, before or after a design is published.

Payment
Wintadreama Design reserves the right to charge the amount of any Value Added Tax payable or PayPal fees whether or not included in the estimate or invoice.

Payments that sent out should be paid promptly. Therefore, you agree to stick to the following payment schedule:

All works other than website builds must be paid in FULL after agreed proofing has been signed off.

Once the payment has been received I will then remove the watermark (Proof design watermark)

Payment Methods
Payment for accepted orders will be made in pounds sterling or any other currency agreed upon in the order confirmation or other written communication sent to the customer from me detailing the order ‐ internet communication.

Wintadreama Design accepts payment by Paypal, and Bank transfer. No PayPal account is necessary to complete your order, but customers need to note that they will be charged a small PayPal charge on the payment amount.

Please note: that payments made via bank transfer need to have a clear and identifiable reference number/name included for payment tracking. This is usually your name. You must email Wintadreama Design to confirm that the transfer has been requested, and provide the date the funds will clear for the tracking purposes.

Proofing designs for Advertisement
Wintadreama Design will supply the customer with a copy of the design with (proof design) watermark.

It is the sole responsibility of the customer to check all content of said proof – including spelling, grammar, punctuation, layout, use of images, etc. Wintadreama Design will provide the customer with a proof copy of the design, the customers should then review and advise the following:

1) Amendments to general design/layout.
2) corrections to text (including grammar and spelling)
It is the customer’s sole responsibility to check all content thoroughly and sign off the proof design.

Once the project has been signed off I will then remove the watermark (Proof design watermark)

Wintadreama Design cannot accept liability for errors within the copy beyond this stage.

Print projects – Color Balancing & Cutting
Printer’s function on the CMYK color model to recreate what is on the screen whereas screens function on the RGB color model. customers are advised that proofs, when viewed on-screen or printed off, are not 100% color accurate and there may be some variation in tone due to lighting effects, paper specifications, etc.

In the case of full-color printing, we can convert print data not sent in CMYK mode, but such conversion will be at the customer’s risk. Conversion of RGB data color profiles will naturally result in deviations in color from the original and liability for these deviations will not be the fault of Wintadreama Design.

Customers need to be aware that the cutting process of any printed products requires a bleed allowance (horizontal & vertical)
It is the sole responsibility of the customer to provide me with any bleed information on projects going to print.

Once a signed off print file has gone to the printers, Wintadreama Design holds no responsibility for any type of graphical errors.

Refunds & Cancellations
Artwork and commissioned design work refunds are not possible whatsoever as this is the labor fee I charge for the designer work/time.

Should something happen for any reason whatsoever that causes you to cancel this project once it has begun. You will simply be billed for any work completed up to the point of cancellation. Should some life-altering event happen to cause me to cancel the project then I will refund you for any payments made on incomplete work.

Wintadreama Design holds the right to cancel or suspend a customer’s service or services for any reason.

If I do not hear from a customer for a period of 14 days then Wintadreama Design reserve the right to ask for any outstanding balance for the project to pay before any more work is carried out. Further to this, If I do not hear from a customer for a period of 1 month Wintadreama Design will assume the customer no longer requires the website/project and the project will be cancelled and all files deleted from the hard drives/servers.

Artwork and uncollected work

Artwork
If Wintadreama Design is designing/creating new artwork for the customer I aim to keep this artwork on file for up to 12 months. In some cases, artwork may be kept for longer periods of time, but this cannot be guaranteed. After 12 months the art work will be deleted.

I are happy to provide the customer with the compressed file of their artwork, for the customer to save/store.

The original design file is the property of Wintadreama Design only, I do not provide original artwork for the customer to either amend themselves or provide to a third party to change or develop under any circumstances.

It is solely the customer’s responsibility to ask for a copy of their artwork or to ensure that files are stored safely, Wintadreama Design cannot be held responsible for any loss or damages occurred from artwork being deleted/lost due to computer malfunction or otherwise.

Uncollected
If any items of work and files belonging to a customer are not collected after 3 months of the requested work being done, Wintadreama Design reserves the right to dispose of such material.

Design Credits:
The customer agrees to allow Wintadreama Design to place a small credit on ALL work.

• On online and print Advertisement
  This will be in the form of text placed on the design with the following wording “Advert designed: WINTADREAMA DESIGN” or words to similar effect.
• On websites
  This will be in the form of text placed towards the bottom of the page with the following wording “Website designed by WINTADREAMA DESIGN”, “Powered by Wintadreama Design” or words to similar effect.
• Any work created by Wintadreama Design
  For any customer may be showcased by Wintadreama Design within our online or offline portfolio. Any artwork which involves works of third parties i.e. supplied designs, logo, photos, may also be used for the purpose of displaying customer’s past works for Wintadreama Design’s portfolio.

Copyright
The Client retains the copyright to data, files and graphic logos provided by the Client, and grants Wintadreama Design the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting Wintadreama Design permission and rights for use of the same and agrees to indemnify and hold harmless Wintadreama Design from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions. Evidence of permissions and authorities may be requested.

Other
We are not responsible for viruses and you must not introduce them.

We do not guarantee that our site or any website built will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our site on any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

Links To Other Web Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by Wintadreama Design

Wintadreama Design has no control over and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that Wintadreama Design shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.

Website Design and Development
Web sample draft, Design is subjective, and for this reason, we offer ‘unlimited design revisions’. This means that we will continue to work with you on your design concept until you are happy with our proposal. The unlimited design revision period ends when the client accepts the design proposal and home page draft. Design changes beyond this point are subject to additional charges.

Wintadreama Design will provide the client with an expected completion time frame for the project (live on the internet) if requested.

Wintadreama Design will not accept responsibility for ensuring that a customer’s website is cataloged or ranked highly by any search engine.

Wintadreama Design cannot guarantee the appearance of any website it designs will not alter within the confines of non-specified browsers or monitor dimensions.

Wintadreama Design shall have no obligation to provide any source code to the customer. In the event that the customer wishes to enter into hosting and maintenance agreements with a third party then the customer acknowledges that Wintadreama Design has no ongoing obligation to provide any support or maintenance of any form.

Content, and publishing
Where digital content is required from the customer, the following formats are acceptable: Text Content – Word, editable pdf or plain text files Images – JPG Logo – PNG, PDF or JPG. All text content should be provided with relevant page titles and structured to how it will appear on the website. Wintadreama Design will not proofread any provided text and are not responsible for incorrect grammar or spelling.

After work on the customer’s web-site has been ceased, Wintadreama Design will not be held responsible for the maintenance, monitoring or upkeep of said site unless otherwise agreed in writing.

With regard to any images or download files uploaded to a customer’s website by a customer, it is the responsibility of the customer to retain a copy of these on their local PC/LAN. In the unlikely event of a hard drive failure or another technical failure with the webserver, it will be the responsibility of the customer to re-upload these files.

We being Wintadreama Design will not be responsible for, or take any responsibility for any copyright infringements caused by the client by them uploading to the website or by the materials submitted to us Wintadreama Design by the client.

Wintadreama Design Will reserve the right to refuse any copyrighted material or anything deemed to be, by the client, unless full proof can be provided by the client of them having the right and permission to use such material for the website ordered.

Web Browsers
Wintadreama Design makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9, Google Chrome, etc.). The client agrees that Wintadreama Design cannot guarantee correct functionality with all browser software across different operating systems.

Wintadreama Design cannot accept responsibility for web pages that do not display acceptably in new versions of browsers released after the website has been designed and handed over to the Client. As such, Wintadreama Design reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.

Before and After the site is live
Before the general use of the website, (going live) the client is expected to fully test any programming and applications which we being Wintadreama Design have developed for the client. It is the client’s full responsibility to check all information, content, spelling, and grammar and email and contact forms is correct before the site is put live.

If the client has any errors, bugs or any other issues with the site after it goes live, Wintadreama Design will try to correct the issues for the client to meet the functioning standards of the brief that formed the order of the website, but point out Wintadreama Design are not necessarily obliged to, or responsible to do so, we reserve the right to charge for the work needed to sort these problems out, because it was the responsibility of the client to test and check the site before it goes live.

Maintenance and Correction of Errors
Wintadreama Design. takes no responsibility for the functionality or maintenance (unless a maintenance contract is in place) of the Website after the Work has been completed. Errors (both technical and typographical) attributable to Wintadreama Design. will be corrected free of charge, but Wintadreama Design. reserves the right to charge a reasonable fee for correction of errors for which Wintadreama Design. is not responsible, including, but not limited to malicious modification of the Website by a third party and typographical errors contained in materials provided to Wintadreama Design. by the Client. Wintadreama Design. also reserves the right to not fix any such errors upon the conclusion of the project.

Maintenance Agreements
Wintadreama Design reserves the right to change the terms of any and all maintenance agreements at any time, for any reason, without prior notice. These changes may effect current contractual agreements.

Backups
A monthly backup is taken of the website and the file is kept for one month. There is no guarantee that: web site backups will be successful every or any time, that we will retain a copy of any and/or all backups or that those backups will be usable for future use. Wintadreama Design, is not liable nor responsible, in any fashion, for any damage or loss of any files, information or any server data during or resulting from these backups. Should any damage occur, Wintadreama Design, will act in good faith and make a valiant effort to resolve the issue, however, there are no set guarantees.

Payments and deposits
There are no exceptions to the terms of the total payment due, which Includes any extra work ordered by the client, either written, in the form of emails, messages, and letters, or by verbal requests made. To which has been added to, and forms a part of the whole order of the website. Also if the client decides they no longer want the site, and at this point, the site has been built and worked on, and has been completed. The client will be subject to the total amount due, and we being Wintadreama Design expect payment in full for the completed work. 

As part of these terms and conditions that the client has entered into with us Wintadreama Design, the client has agreed to the contract for the work ordered, and to the amount due.  

Failure to pay could lead to legal action to recover the amount due if it becomes necessary.

Unless otherwise stipulated in writing, it is the customer’s sole responsibility to ensure annual payment for the domain name and web-space associated with their site.

If payment has not been received by the due date, Wintadreama Design has the right to suspend ongoing work for the client and hosting services or domain, if applicable, until such time that full payment of the outstanding balance has been received. If full payment has still not been received after the final reminder due date, Wintadreama Design has the right to replace, modify or remove the Website of the Work until full payment has been received.

Website builds payment

A website build on Bronze, Silver and Gold, Deluxe and Deluxe Pro packages

All payment plans must be made via Go Cordless and is collected monthly. 

After 12 months all plans change to your selected Monthly subscription service (Stadard Hosting and Deluxe Hosting Packages)

Domain
Domains are purchased through 20i UK (the registrar) and are subject to their terms and conditions available here www.20i.com

Domain fees are charged +VAT per annual.

Ongoing Domain registration fees will be charged accordingly and may be subject to change or increase beyond Wintadreama Design’s control.

Domain name is none refundable. Wintadreama Design offers NO refunds if you cancel your Domain during your current annual billing period.

All domains are purchased using the contact name and details for Domain fees. This stops unwanted spam from being sent to the customer.

There is a period of 7 days from the point of renewal date where the domain can be re-purchased without the registrar applying additional charges.

After the 7 days, the domain may be re-purchased, but the registrar may charge a penalty at this point. Wintadreama Design also charges admin fees. The expected fees are:

Please note if the domain becomes lost It will most likely be parked by a third party and the re-purchase fee will be even higher.

Moving a domain to another provider would need to be done before your hosting is due for renewal.

Should the domain move be completed before the hosting is renewed a hosting repayment is only due to the customer if the term left is more than 30 days.

Mailbox
Although Wintadreama Design may offer the set-up of mailboxes as part of its domain service, it cannot be held responsible for any problems that occur as a result of the customer’s own email software or set up.
